***What right does the government have to subject us to irradiated food without our knowledge. Before applying a knee jerk reaction shouldn't other options be thoroughly explored? Is it really such a big problem that we will take a chance in creating even a more devastating problem?
***Stop irradiating spinach and lettuce.It is not healthy. Have concern for people rather than the greed for money that rules you-you Satinists.

***I am deeply concerned about our foods being radiated in the market place. I do not wish to eat such foods and it is my understanding that those foods will not be as nutritious as they once were. PCC Natural Markets is the largest consumer-owned grocery retailer in the United States with nine stores in the Puget Sound region of Washington state. Our customers are concerned that irradiation compromises the quality and safety of food. Research shows that irradiation destroys vitamins and other nutrients, and also can create dangerous chemical byproducts. Very few tests have been done to determine the long-term health consequences of eating radiated food, not to mention the effect on flavor, texture and overall quality. Food irradiation also is expensive to implement and is a distraction for the unsanitary conditions of the industrialized food system. It does not address the systemic, root causes of contamination. I urge you to repeal the approval of irradiation of fresh spinach and lettuce and instead enforce existing regulations that would ensure the safety of our food supply. The safety of these things is very much in question and we do not want to put our health and especially our childrens health at risk with unproven long term affects. Considering the uproar about trans-fats and how the people have made laws to insure consumers know that they are eating trans-fats in restaurants and other places, the federal government should take heed and make sure that people across the board know what they are eating. Irradiated food is not optimal for the consumer. Fresh food is optimal. If people do not know that they are eating irradiated food, then they are not receiving optimal nutrition nor are they receiving optimal information. This is not only a health issue but a national security issue as well. *** Please think about this decision. Most people eat vegetables because they are full of life and nutrients. Now, if someone treats them with something that kills life (bacteria), doesn't it make sense that it will also kill the nutrients of the vegetable as well? Now supermarkets may be required to label the veggies as irradiated. But restaurants, schools, hospitals, and nursing homes won't have this requirement. You could go for an evening out and come home with a belly full of nuked food. Something stinks here.
***Regarding the SAFE production, processing an handling of food I recommend instead of an industrial process of radiation, an extra energy cost, what needs to be conducted is localized food production. More funding should be in this area. I believe some new technologies for greenhouse production would eliminate the reason why scientists at the FDA think irradiation should even be considered as an option for protecting our food. It is impossible to protect our food when the process of irradiating our food inevitably causes harm to our food. Removing even the smallest amount of vitamin, or as in the case of irradiated meat, likely creating carcinogens like benzene is dangerous and against everything I study in sustainable nutrition. When one looks at the big picture of how what we eat affects our energy level, our mood, our behavior, and consequently our evolution, and our environment, as with GMOs, irradiation is obviously another terrible retrogression and in my opinion an illogical use of scientific technology. Again science is overstepping its boundaries.

***The Process of Irradiation Not only kills disease causing pathogens but also kills important nutrients including vitamins and essential fatty acids. Serious health problems in laboratory testing has developed including premature death, fatal internal bleeding, cancer stillbirths and other reproductive problems, mutations and other genetic damage, organ malfunctions, stunted growth and vitamin deficiencies. The FDA should be looking out for our well being and encouraging food being produced in the most natural way possible. There are enough contaminants us humans have to worry about without shooting ourself in the foot. The government and big business is worried about the high cost of medical bills, well guess what, if you proceed in this manor you will just be making the problem all that must worse. It is a shame that the FDA has lost site on why they were created in the first place.
***RE: Docket No. FDA-1999-F-2405 (formerly 1999F-5522) Irradiation in the Production, Processing and Handling of Food – OBJECTIONS, HEARING AND STAY REQUEST http://www.regulations.gov Dear Sir or Madam: Under the provisions of 21 C.F.R. 12.24 (2008), Food & Water Watch is requesting a stay of action and a formal evidentiary public hearing for the purposes of revoking the Food and Drug Administration's (FDA) above referenced Final Rule, published in the Federal Register at 73 FR 49593-49603 (August 22, 2008). Food & Water Watch (FWW) is a national non-profit, membership consumer organization established in 2005 that works to ensure clean water and safe food. We challenge the corporate control and abuse of our food and water resources. Objections We concur with all of the objections filed by the Center for Food Safety in their submission on September 17, 2008. As you know, those objections focused on five areas: #61550; FDA failed to determine the magnitude of nutrient losses to be expected from the irradiation of fresh spinach and iceberg lettuce at or near the maximum permitted dose of 4 kGy; #61550; FDA underestimated substantially the national contributions of fresh spinach and iceberg lettuce to American diets, and consequently underestimated the impacts of irradiation-induced nutrient losses in those vegetables on American diets; #61550; FDA failed to conduct a cumulative assessment of irradiation-induced nutrient losses in other foods already approved for irradiation and the agency should undertake such an assessment before approving irradiation of spinach and iceberg lettuce; #61550; FDA failed to determine whether the irradiation of fresh spinach and iceberg lettuce as permitted in the final rule would increase the risk of forming food-borne pathogens that are resistant to irradiation; #61550; The Department of Health and Human Services still has not acted upon proposals to create a regulatory regime that would set commodity-specific pathogen performance standards for the produce industry even though there is widespread support among stakeholders for such establishing such a program. Instead, the FDA keeps on entertaining impractical, questionable and expensive technological substitutes for meaningful food safety standards. We believe that the discussion provided by the Center for Food Safety in its September 17, 2008 comments on each of these issues provide the basis for opening a public evidentiary hearing on the approved rule. We will not repeat those arguments here. In addition to those objections, FWW believes that there is a basis to stay the approval of the August 22, 2008 rule and convene a public evidentiary hearing on the issue of the quality of the irradiated produce at the dose level approved and whether there is technology currently available to achieve the pathogen reduction desired while still preserving the organoleptic properties of the produce. While conceding that irradiation can cause organoleptic changes in foods, the agency dismissed those concerns, and the findings of its own staff, claiming that the issue is outside the scope of the rulemaking. We strongly disagree. If there is no practicality considered while approving the technology, what good is its approval? Under the Food, Drug and Cosmetic Act, 21 U.S.C. 348 (2000), FDA is not to approve a food safety additive petition if its use will be unsafe, promote deception of the consumer or result in adulteration, or in misbranding of food within the meaning of the Act. Approving this petition for irradiation, when it might not achieve the desired results and creates organoleptic degradation, raises issues of safety and deception that call into question whether FDA can approve this petition and comply with the Food, Drug and Cosmetic Act. Organoleptic Degradation Responding to an agency request to review the microbiological aspects of using ionizing radiation to reduce or eliminate microorganisms on or in fresh iceberg lettuce and spinach, FDA microbiologist Dr. Robert Merker highlighted various studies that indicate that irradiation does cause the quality of fresh produce to degrade and the problem is exacerbated as the dose is increased. While there has been research to indicate that irradiation can be effective in reducing the level of food borne pathogens in loose leafy greens at doses as low as 1 kGy, researchers concede that in a bagged environment, much higher doses are needed in order to irradiate all portions of the leaf and to all leaves in the bag. It is our understanding that the petitioner's intent was to use the technology on bagged leafy greens. Merker summarized research conducted by scientists at USDA's Agricultural Research Service who found that the quality attributes of irradiated iceberg lettuce deteriorated at 3 kGy or 4 kGy because of damage to membrane systems. Other studies conducted by these same scientists found that irradiation levels above 1.5 kGy or 2 kGy lowered the quality of leafy greens. In a 2008 study by Gomes et al, researchers found that higher irradiation dosages would be needed to ensure the elimination of all food borne pathogens from all spinach leaves within a bag. Merker concluded in his memo that several studies noted losses in quality or sensory factors in lettuce or spinach irradiated above 2 kGy. "Practical application, however, could require somewhat higher doses to achieve sufficient exposure to the irradiation of all portions of the leaf or to all leaves within a bag, for fresh cut items." Furthermore, there have been observations made by noted food safety experts who have questioned the practicality of the FDA approval of this petition. Dr. Mike Doyle, Director of the Center for Produce Safety at the University of Georgia recently stated that while there have been laboratory studies showing the efficacy of irradiation on reducing the levels of pathogens on leafy greens without impacting the organoleptic characteristics of the product, "in a commercial processing plant, products are stacked in cartons for treatment, so the dose must be strong enough to irradiate every part of the package and that could lead to some products being 'overly treated,' which could render the product unappetizing." Therefore, it is unlikely that irradiation at the levels needed to prevent damage to the produce degradation will actually be employed to achieve pathogen reduction. If pathogen reduction is not achieved, it is a serious safety and consumer deception issue. This needs to be evaluated by FDA before approval is given for this use of irradiation. If on the other hand, produce is provided larger doses of irradiation to deal with the fact that it is within bags or cartons, the result could be inconsistent or damaged produce that would deceive the consumer, who is unable to determine the quality of the product due to the packaging. Irradiation is not effective on all food borne pathogens. Irradiation is not effective against all pathogens that might contaminate food. For example, it is not effective against viruses, such as noroviruses, that have been implicated in a significant number of food borne illness outbreaks involving produce in recent years. Irradiation will not reduce the number of consumers becoming ill from eating produce that has been contaminated with noroviruses. And the fact that the produce may be irradiated could lead consumers to the incorrect conclusion that the product is safe to eat even though it may still be contaminated with a pathogen that is resistant to the technology. Conclusion For all of the reasons cited above, we believe that there should be a stay of the final rule and that a public evidentiary hearing should be convened to discuss the shortcomings of the FDA approval of the final rule. Now, if someone treats them with something that kills life (bacteria), doesn't it make sense that it will also kill the nutrients of the vegetable as well? I'll grow my own before I eat irradiated food. So in the end -- this will cause yet another economic failure. Without consumer support, it is doomed to fail. You must require that irradiated food be LABELED so that any consumers who wish to may avoid injesting it. Not to do so will open you to massive law suits. It is a bad way out of yet another government failure. You will be the cause of the next pull-down that will lead our country back to the dark ages. YOU make the farms clean. Put your considerable resources into figuring out how to avoid this travesty of irradiating food. Perhaps you can generate a whole new area where Americans can find careers. I know you can do it without resorting to irradiation. Protect us, don't nuke us!

***From the moment fresh food is "harvested", it begins to lose nutritive value at a logarithmic rate. While ionizing radiation may kill microorganisms that digest the food, producing substances that are undesirable to humans, even toxic, I believe that it also accelerates the nutritive degradation. Even if it did NOT do so, it still yet facilitates the ability of old, nutritively-poor food to be sold to unwitting consumers, unable to be alerted to the age of the food by the telltale signs of bacterial decomposition. Food should not simply be sold in order to give consumers the ability to have a feeling of having eaten something-- it should be for giving them the ability to be healthy! ***To Whom It May Concern, I am a physician and I am a firm believer in preventive medicine. Let's improve the purity of our food and water supply by first enforcing the laws already on the books. Crack down on producers and countries that export to our country products that are contaminated with chemicals, bacteria, lead, etc. Give incentives to these countries (such as lower tariffs) to police and monitor themselves to ensure a safer food supply. Keep American products here at home instead of exporting them for greater profits forcing us to import tainted and infected produce from China, Mexico and other countries. Expand the services of the FDA with more inspectors in the field especially at the ports of entry where very few container ships are ever inspected. This is not only a health issue but a national security issue as well. Instead, I think FDA should recommend cooking the vegetable to kill bateria.

Some major concerns with food irradiation include: -The formation of free radicals, which can set off chain reactions in the body that destroy antioxidants, tear apart cell membranes, and make the body more susceptible to cancer, diabetes, heart disease, liver damage, muscular breakdown and other serious problems. -Serious health problems in laboratory testing, including, including premature death, fatal internal bleeding, cancer, stillbirths and other reproductive problems, mutations and other genetic damage, organ malfunctions, stunted growth and vitamin deficiencies. -The creating mutant forms of dangerous bacteria, like E. coli and Salmonella -Nutrient loss in foods, including the destruction of vitamins and essential fatty acids. -The formation of carcinogenic chemicals, like benzene and toluene. -While irradiated lettuce and spinach must be labeled in supermarkets, there are currently no labeling requirements for restaurants serving irradiated produce or other items. Patrons and clients may consume irradiated lettuce and spinach in the future without their knowledge, nor consent.
*** I am disgusted by the use of irradiation in food. It is proven to decrease the nutritional value of food as well as cause cancer and it also increases the risk of mutant forms of E. Coli and Salmonella. It is not proven to decrease the likelihood of food-borne pathogens and I think that the FDA should consider consumer opinions before allowing this law to remain in effect.
***I am concerned about irradiation of vegetables. I notice that a notice is required in supermarkets but not in restaurants. I hope that notification is required at all places irradiated foods are served.

The existence of pathogens in spinach and lettuce is merely a symptom of the larger problem ---- waste coming from animal feed lots! Why not put the burden on those who are creating the problem? ***I am deeply concerned about our foods being radiated in the market place. I do not wish to eat such foods and it is my understanding that those foods will not be as nutritious as they once were. I would prefer it not happen and that instead of covering up the mistakes made by the producers, they should be corrected in the field. If foods are radiated without the public's knowledge in the market place and in restaurants, I think that is a crime. We should have a choice and know more about what has been put on those foods we consume, including all other toxins like pesticides and herbicides. Radiation is just another way to make our foods less desirable and unhealthy. If this happens I think America, will be sicker because of it.
